Employer Terms of Service

These terms apply to companies that post roles on Resvia AI and receive candidate applications. Job seekers are covered by our general Terms of Service instead.

1. Acceptance of These Terms

These Employer Terms of Service ("Employer Terms") govern your use of Resvia AI as an employer. By creating an employer account, publishing a job posting, or receiving candidate applications, you ("Employer," "you") agree to be bound by these Employer Terms and our Privacy Policy. If you are entering into these Employer Terms on behalf of a company, you represent that you have authority to bind that company. Our general Terms of Service govern job-seeker accounts and do not apply to employer accounts. If you do not agree, do not use the employer side of the Service.

2. The Employer Service

Resvia AI ("we," "us," "Service") lets approved companies publish job postings that are surfaced to relevant candidates, receive applications natively in the platform with a tailored resume attached, and review those applicants with the help of an AI screen. You may optionally supply the inbound address of your own applicant tracking system, in which case each application is also emailed there with the resume attached so it files itself onto the correct requisition.

3. Eligibility, Approval, and Suspension

Employer accounts begin in a pending state. We review each account before any posting becomes visible to candidates, and we may approve, decline, or later revoke approval at our sole discretion. A posting reaches candidates only while your account is approved and that posting is active. We may remove any posting, or suspend or terminate an employer account, at any time and without notice, including where we believe these Employer Terms have been breached.

4. Posting Accuracy

4.1 Genuine Openings. Each posting must describe a real, currently open role for which you are actively hiring. You must deactivate or mark as filled any posting that is no longer open.

4.2 Your Own Roles. You may post only roles at your own company. Staffing agencies, recruiting firms, and outsourcing or consultancy intermediaries may not post roles on behalf of third parties.

4.3 No Misrepresentation. Titles, locations, work arrangement, compensation ranges, and role descriptions must be accurate and not misleading. You may not advertise a role on terms that differ materially from the role actually offered.

4.4 Imported Postings. Where you import postings from an external job board or careers page, you are responsible for their accuracy once published, exactly as if you had written them here.

5. Lawful and Non-Discriminatory Hiring

5.1 Your Responsibility. You are solely responsible for your hiring decisions and for complying with all applicable employment, equal-opportunity, anti-discrimination, pay-transparency, and background-check laws in every jurisdiction in which you hire. Resvia AI is not your employer of record, agent, or employment agency.

5.2 Selection Criteria. You may not use the Service to express, imply, or apply any preference or limitation based on race, color, religion, sex, sexual orientation, gender identity, national origin, age, disability, veteran status, or any other characteristic protected by applicable law.

5.3 AI Screening Is Not a Decision. Applicant scores, rankings, and summaries produced by the Service are AI-generated aids for your own review. They are not hiring decisions and must not be used as the sole basis for one. Where applicable law regulates automated employment decision tools, you are responsible for the notices, consents, and assessments that law requires of you.

6. Candidate Data

6.1 Permitted Purpose. When a candidate applies, you receive their application materials, which may include a tailored resume, their name and contact details, a cover note, and answers to any questions you configured. You may use this information solely to evaluate and communicate with that candidate about that role and other roles at your company.

6.2 Prohibited Uses. You may not sell, license, or otherwise disclose candidate data to any third party; add candidates to marketing or advertising lists; use candidate data to train machine-learning models; or repurpose it for anything unrelated to your own hiring.

6.3 Independent Controller. Once you receive candidate data, you determine how it is used and are an independent controller of it. You are responsible for handling, securing, retaining, and deleting it in accordance with applicable data-protection and record-retention law, and for honoring candidate rights requests you receive directly.

6.4 Forwarding. If you configure a forwarding address for your own applicant tracking system, you direct us to send applications there and are responsible for that system and the address you provide.

6.5 Confidentiality. Candidate application materials are confidential. You must restrict access to personnel with a genuine need to evaluate the candidate.

7. No Fees to Candidates

You may never charge a candidate any fee in connection with a role sourced through the Service, and you may not use the Service to solicit payment from candidates, to sell them training, equipment, or services, or to recruit for unpaid work misdescribed as employment.

8. Fees

Posting is currently free for eligible companies. We may introduce fees for the employer Service in the future, and will give at least 30 days' notice before any fee applies to your account. Postings that are live when a fee is introduced will not become chargeable without your agreement.

9. AI-Generated Content

Candidate matching, applicant screening, resume parsing, and posting import are performed by AI models and may contain errors, inaccuracies, or omissions. Imported postings in particular are parsed automatically and must be reviewed by you before activation. We make no warranty that AI-generated output is accurate, complete, or suitable for any purpose, and you must independently review it before acting on it.

We do not guarantee any number of applicants, any level of applicant quality, or that you will fill any role.

10. Prohibited Uses

You agree not to use the Service to post fraudulent, deceptive, or non-existent roles; harvest candidate data for any purpose other than your own hiring; contact candidates for sales, fundraising, or marketing; post roles that are unlawful or that promote illegal activity; scrape or reverse-engineer the Service; impersonate any person or company; or attempt unauthorized access to the Service or its infrastructure.

11. Intellectual Property and Your Content

The Service and its content are owned by Resvia AI and protected by applicable intellectual property laws. Your postings, company name, logo, tagline, and company description remain yours.

You grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, and display that content to candidates and within the Service for as long as your account or postings are active, solely to operate and promote the Service. You represent that you have the rights to the content you upload and that it does not infringe the rights of any third party.

12. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not verify candidate-supplied information and make no representation as to the accuracy of any resume, credential, or work authorization status.

13. Limitation of Liability

To the maximum extent permitted by law, Resvia AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including lost hires, hiring costs, or reputational harm. Our total aggregate liability arising out of these employer terms shall not exceed the greater of the fees you paid us in the twelve months preceding the claim or one hundred U.S. dollars.

14. Indemnification

You agree to indemnify and hold harmless Resvia AI and its personnel from any claims, damages, or expenses arising from your postings, your hiring decisions, your handling of candidate data, your violation of these Employer Terms, or your violation of any applicable employment or data-protection law.

15. Termination

You may close your employer account at any time. We may suspend or terminate your account or any posting for violation of these Employer Terms or at our sole discretion. On termination, your postings are removed from the Service immediately and your right to use the Service ceases. Your obligations regarding candidate data you have already received survive termination.

16. Changes to These Terms

We may update these Employer Terms from time to time. We will notify you of material changes by email to your account contact address. Continued use of the employer Service after changes take effect constitutes acceptance.

17. Governing Law

These Employer Terms are governed by the laws of the State of Delaware without regard to conflict of law principles.
